The U.S. Supreme Court heard oral arguments in Dobbs v. Jackson Women’s Health Organization, a case with the potential to overturn Roe v. Wade and Planned Parenthood v. Casey. In 2018, Mississippi enacted a law that limits abortions after 15 weeks of pregnancy—except in cases of medical emergency or severe fetal abnormality.
In Dobbs, the question before the court is straightforward: Are all pre-viability elective abortion bans unconstitutional? That is, can states protect unborn children before they are able to survive outside the womb?
Here are the possible outcomes:
The court upholds Mississippi’s abortion ban by overruling Roe and Casey; the justices reach the same result by narrowing or modifying—rather than overruling—those precedents; or the court strikes down the Mississippi ban by reaffirming Roe and Casey.
With an estimated 62 million innocent lives lost since the Supreme Court’s 1973 ruling in Roe v. Wade, Dobbs provides the court with its best opportunity in decades to correct its grave error.
