703 May 10,1989 REPORT ON VOTING PRACTICES AT THE UlWED NATIONS 43RD GENERAL ASSEMBLY INTRODUCTION Because of its increasing dismay that nations routinely vote against the United States at the United Nations and other inte rnational bodies, Congress in 1983 rhandated that these votes at least be tabulated and published. As such, two laws, P.L 98-164 and P.L. 99-500, require the State Department to submit an annual report to Congress on the voting practices of the member cou n tries of the U.N. in international organizations. This report, commonly called the Kasten Report after the sponsor of the enabling legislation Senator Robert Kasten, the Wisconsin Republican, has become an important tool of evaluation for U.S. policy make rs and commentators. The Kasten Report has maintained the same format and methodology from year to year to provide the continuity necessary for analyzing and comparing voting performance over time. This should be continued, yet there is now question whether it will be in future State Department reports on voting practices in the United Nations. Several legislators, led by Senator-Edward Kennedy, the Massachusetts Democrat, have proposed changes to the Kasten Report that could seriously undermine its integrity. Distorting the Results. The mos t potentially damaging of the proposed changes would be the inclusion of consensus decisions in the calculation of how often a nation votes with the U.S called voting coincidence. Including consensus resolutions would distort the results enormously. The r e ason consensus resolutions of the U.N. General Assehbly or of any other legislative body are often non-controversial and frequently do not even touch on policy issues. Many are housekeeping resolutions involving such routine matters as membership on conti n uing committees and commissions and the NOTE OF like. Examples from the 43rd General Assemb1pwhich met from September to December, 1988, include Resolution 43/402, Adoption of the Agenda and Allocation of Agenda Items, and 43/301, Appointment of the Membe r s of the Credentials Committee designate years of celebration and various tributes and honors. Typical are Resolution 43/179, declaring a Transport and Communications Decade in Africa, and Resolution 43/90, noting the Fortieth Anniversary of the Universal Declaration of Human Rights consensus resolutions of genuine substance like, the resolutions of the 43rd General Assembly on the biennial budget plan but the unanimity recorded in the final votemasks the hard bargaining and tradeoffs that make it possible to achieve consensus at the end. Even then, consensus may have been reached only when some nation or nations retreated from a principled position. The meaningful divisions over issues of substance are hidden in committee proceedings or in informal negotia tions, if in fact they are recorded at all. Common to all of these categories of consensus is the fact that the final vote, or non-vote, is substantively meaningless. Including such resolutions in a voting scorecard, therefore, skews the record, making U.N . proceedings seem much more harmonious and collegial than they are. As in any legislative body, the most accurate record is that focusing on definable differences in interests, principle, and policy.The methodology used in the Kasten Report reflects that approach. Because of the proposed threats to the Kasten Reports integrity, The Heritage Foundations United Nations Assessment Project has tabulated and sorted the votes at the U.N. in a manner consistent with the Kasten Reports of the past five years.This report provides the necessary continuity and Comparability by presenting the percent coincidence of countries votes with the U.S. at the 43rd General Assembly using the methodology of the Kasten Reports. In addition, it contains the percent coincidence o f countries votes with the U.S.S.R. and categorical breakdowns according to the major issues dealt with by the 43rd General Assembly, data not included in the Kasten Report but important to the analysis of countries performance in the General Assembly Othe r consensus resolutions known as motherhood resolutions Hard Bargaining. At every U.N. General Assembly there are a few METHODOLOGY AND SOURCE DATA The tables showing percent coincidence of countries votes with the U.S and with the Soviet Union take into a c count recorded votes that occurred 1 The first number in a resolution refers to the General Assembly session which passed it; the second number following the slash, indicates the numerical order in which it was passed. Resolution 431402 was the 402nd reso l ution passed by the 43rd General Assembly 2 during the 43rd General Assembly, which held its plenary session from September 20,1988 to December 22,1988.They are calculated on the basis of yes/no votes only.They do not take into account absences or abstent ions they do not include decisions made by consensus. The sum of the number of recorded votes on which a nation voted yes when the U.S. voted yes or ccnoy when the U.S. voted no yields a total agreement with the U.S.The sum of the number of recorded votes on which a nation voted yes or no and the U.S. voted yes or no yields that nations total yes/no votes.Each nations percent coincidence with the U.S. on all recorded General Assembly votes is derived by dividing that nations total agreement with the U.S. b y its total yes/no votes. Dividing the sum of all nations total agreements with the U.S. by the sum of all nations total yes/no votes yields the average overall coincidence with the U.S. The calculations are based on data from Resolutions and Decisions Ado pted by the General Assembly During the First Part of its Forty-Third Session (United Nations Department of Public Information Press Release GA/7814, January 16,1989 and from Resolutions and Decisions Adopted by General Assembly at its Resumed Forty-Third Session (United Nations Department of Public Information Press Release GA/7814/Add.ly March 16 1989) except for the 27 paragraph votes and one procedural vote, which are based on data obtained from the U.S. Department of State PATIERNS OF VOTING AT THE U. N The average overall coincidence with the United States in the 43rd General Assembly was 15.22 percent.This is the lowest level of support for U.S. positions at the U.N. in the six years that the Kasten Reports have been compiled. Average overall coincide n ce of voting with the Soviet Union meanwhile was a remarkable 95.15 percent range of issues, the majority fell into one of four topical categories average coincidence with the U.S. 2.72 percent; average coincidence with the U.S.S.R. 97.04 percent Though t h e 166 votes in the 43rd General Assembly covered a very broad 1) Economic development/international regulation issues 9 votes Examples Resolution 43/18: The JAW of the Sea U.N. congratulates itself for drafting the Law of the Sea Treaty. Calls upon all na t ions that have not done so to sign it, and if not, to observe its provisions I Resolution 43/60 A: Questions Relating to Information Urges elimination of imbalances in news reporting on developing countries (meaning criticism that does not take into accou n t the interests, aspirations, and socio-cultural 3 values of all peoples) and mandates that the U.N.3 Department of Public Information cooperate more closely with UNESCO (from which the U.S. withdrew in 1985 2) Southern African Issues 29 votes: average co incidence with the U.S. Examples: Resolution 43/50 A International Solidarity with the Liberation Struggle in South Africa 7.91 percent; average coincidence with the U.S.S.R. 93.22 Reaffirms U.N. official recognition of the African National Congress and th e Pan Africanist Congress as national liberation movements, with the right to use any necessary means, including armed struggle, to end apartheid in South Africa; orders South Africa to lift its state of emergency and end various repressive measures. Reso lution 43/92: Adverse Consequences for the Enjoyment of Human Rights of Political, Military, Economic, and Other Forms of Assistance Given to the Racist and Colonialist Regime of South Africa Condemns trade with South Africa, singling out major Western na t ions and Israel; calls for comprehensive and mandatory sanctions; and calls for all states and organizations to extend all possible co-operation to the liberation movements of Southern Africa (meaning such terrorist groups as the African National Congress and the SouthWest Africa Peoples Organization 3) ArabDsraeli issues 36 votes: average coincidence with the U.S. 19.79 Examples: Resolution 43/54 A The Situation in the Middle East percent; average coincidence with the U.S.S.R. 92.27 percent Condemns Israe l for terrorist, aggressive, and repressive measures within and outside occupied Palestinian territory; condemns the U.S. for economic and strategic assistance to Israel; demands the immediate unconditional and total withdrawal of Israel from all. the terr itories occupied since 1967. Resolution 43/176: Question of Palestine Demands that Israel withdraw from the Palestinian territory occupied since 1967, including Jerusalem, and from the other occupied Arab temtories (emphasis added and calls for a Middle Ea st Peace Conference under U.N auspices and for placing Palestinian territo ry under the supervision of the United Nations for a limited period, as part of the peace process 4 4) Disarmament issues. (44 votes: average coincidence with the U.S. 16.66 Exampl e s Resolution 43/70: Prevention of an Arms Race in Outer Space Insists that outer space should be used exclusively for peaceful purposes; calls upon the U.S. and the Soviets to undertake bilateral negotiations in a constructive spirit aimed at reaching ear l y agreement for preventing an arms race in outer space. (This echoes almost verbatim the Soviet line against the U.S. position on development of defenses against nuclear weapons percent; average coincidence with the U.S.S.R. 97.97 percent Resolution 43/64 : Urgent Need for a Comprehensive Nuclear-Test-Ban Treaty Calls for an end to nuclear testing by all States in all environments for all time This, too, is the Soviet position and opposes the U.S. stance in an arms-control issue 5) Other Issues, on which th e re were 48 votes, include such resolutions as Resolution 43/49: Report of the Committee on Relations with the Host Country Condemns the U.S. for denying a visa to Palestine Liberation Organization chairman Yassir Arafat and establishes a special session o f the 43rd General Assembly held in Geneva from December 13 to December 15,1988. Resolution 43/137: The Situation of Human Rights in the Islamic Condemns Iran for various human rights abuses, although noting some hopeful signs. Since a majority of U.N memb er states have poor human rights records condemnations of specific countries indicate a nations diplomatic isolation more than anything else. Yet such enemies of the U.S. as Iran and Afghanistan have come in for much softer and less frequent criticism tha n do Israel and South Africa Republic of Iran Resolution 43/11: Judgement of the International Court of Justice of 27 June 1986 concerning military and paramilitary activities in and against Nicaragua: need for immediate compliance In effect, this resoluti o n affirms the International Court of Justices (ICT) opinion in Nicarupa vs. United States that General Assembly Resolutions constitute a form of international law, a position the United States has always and for good reason) strongly opposed. It also deni es the 5 U.S. its right, as expressed in the U.N. Charter, to deny ICJ jurisdiction over a dispute. Included in these votes were 27 taken on specific paragraphs of certain resolutions. There was also one procedural vote; the perennial illegal attempt to ex clude Israel from participation in the General Assembly by denying credentials to the Israeli U.N. delegation. The breakdown of voting coincidences with the U.S. and the Soviet Union on each of these topics is shown inTable IV Of these 166 votes taken in t he 43rd General Assembly, the U.S. voted for 15, against 112, abstained on 36, was absent once, and refused to participate on two. The Soviet Union voted in favor of 159, against two, abstained on two, was absent for one, and refused to participate on two . A list of these resolutions, their titles, and their respective categories appears in Appendix C Voting Blocs. In the General Assembly, typically, member states form blocs, much like the political parties in Western democracies.These blocs are based on c o mmon geographical, cultural, religious, political, and ethnic characteristics. Among the U.N. blocs are: the African Group, Arab Group ASEAN, Asian and Pacific Group, Eastern European Group, European Economic Community, Islamic Conference, Latin American G roup, NATO Non-Aligned Movement, Nordic Group, Warsaw Pact, Western European and Others Group. While there are other groups formally associated with the U.N like the Organization of African Unity, League of Arab States, and the Organization of American St a tes, the thirteen listed above comprise the best breakdown for analyzing bloc voting in the General Assembly. Membership in and overall voting coincidence by these thirteen major blocs is shown in Appendix A Non-Aligned Movement had a 99.36 percent averag e coincidence with the Soviet Union and only a 9.50 percent average coincidence with the U.S. On economic development and international regulatory issues, the voting of the Non-Aligned Movement as a group is even more skewed, with a 100 percent coincidence with the Soviet Union and a 0 percent coincidence with the U.S. Even excluding votes on issues regarding the Arab-Israeli conflict and Southern Africa (which together comprise 39 percent of all resolutions voted on in the 43rd General Assembly the average voting coincidence with the U.S. is still only 18.59 percent.The African Group, excluding votes pertaining to Southern Africa, has an average voting coincidence of 11.41 percent with the U.S. The Arab Group and the Islamic Conference have average voting c oincidences with the U.S. of 7.32 percent and 10.73 percent respectively By far the most powerful bloc with 99 member states, the so-called 2 Although the U.S. is a member of NATO and the Western European and Other Group and the USSR is a member of the Wa rsaw Pact and Eastern European Group, they are excluded from the figures in Appendix A for comparison purposes 6 when votes dealing with the Arab-Israeli conflict are excluded. These and other special categories are contained in Appendix B. Every year sinc e 1982, a group of countries has tried to prevent Israel from participating in the General Assembly. This attempt comes in the form of a vote on whether to accept the credentials of the Israeli delegation. Forty-one countries voted to deny Israeli credent ials in the 43rd General Assembly? Small Thanks for U.S. Aid. The U.S. failed in the 43rd General Assembly to get even those countries which receive substantial U.S. aid (except Israel to support U.S. positions in the U.N. Egypt the number two recipient of U.S dollars, receiving $2.3 billion in fiscal 1987 had an overall voting coincidence with the U.S. of only 8.62 percent. Pakistan received $646 million from the U.S. in fiscal 1987 and had a 8.94 percent overall coincidence. The average voting coincidence with the U.S. of the top 50 recipients of U.S. bilateral aid was 14.32 percent.Their coincidence with the Soviet Union was 96.62 percent. These countries and their individual voting coincidences are shown inTable 111 J CONCL U SION Making the reasonable assumption that U.S. votes in the General Assembly reflect U.S. policy goals and interests, the overall voting performance of the majority of the U.N. member states demonstrates that the U.N. agenda is largely inimical to U.S. i nterests. The U.S. is almost always isolated on the issues that matter most -those on which a vote is taken. Perhaps more important, the Soviet Unions positions are almost always endorsed by the majority at the U.N. With an all-time low overall voting coin cidence of 15.22 percent and more all-time lows among its allies, the U.S appears to be faring quite poorly at the U.N. Holding Nations Accountable. George Bush should take these appalling figures to heart and instruct his new Ambassador to the U.N. in Ne wYork to advise U.N. member states that their performance in the General Assembly will have a bearing on their bilateral relationship with the U.S.This should be backed up by providing the records of voting performance at the U.N. to each U.S. embassy abr o ad and requiring those missions to inform the local government of the record.The U.S. Ambassador then should advise the local government that continued poor performance will elicit appropriate 3 The number of countries voting to deny Israeli credentials h a s been as high as 43 in 1983 and as low as 39 in 1987 4 FY 1987 U.S. economic and Military Assistance Actual Obligations, in Agency for International Development Congressional Presentation, Fiscal Year 1989, Main Volume, pp. 504-507 7 responses from Washi ngton. While this by no means should be the only factor for determining aid and loans from the U.S it should play some role in that. Where possible, financial assistance should be used as leverage to encourage support for U.S. positions on important issues at the U.N Mark A. 703 May 10,1989 REPORT ON VOTING PRACTICES AT THE UlWED NATIONS 43RD GENERAL ASSEMBLY INTRODUCTION Because of its increasing dismay that nations routinely vote against the United States at the United Nations and other inte rnational bodies, Congress in 1983 rhandated that these votes at least be tabulated and published. As such, two laws, P.L 98-164 and P.L. 99-500, require the State Department to submit an annual report to Congress on the voting practices of the member cou n tries of the U.N. in international organizations. This report, commonly called the Kasten Report after the sponsor of the enabling legislation Senator Robert Kasten, the Wisconsin Republican, has become an important tool of evaluation for U.S. policy make rs and commentators. The Kasten Report has maintained the same format and methodology from year to year to provide the continuity necessary for analyzing and comparing voting performance over time. This should be continued, yet there is now question whether it will be in future State Department reports on voting practices in the United Nations. Several legislators, led by Senator-Edward Kennedy, the Massachusetts Democrat, have proposed changes to the Kasten Report that could seriously undermine its integrity. Distorting the Results. The mos t potentially damaging of the proposed changes would be the inclusion of consensus decisions in the calculation of how often a nation votes with the U.S called voting coincidence. Including consensus resolutions would distort the results enormously. The r e ason consensus resolutions of the U.N. General Assehbly or of any other legislative body are often non-controversial and frequently do not even touch on policy issues. Many are housekeeping resolutions involving such routine matters as membership on conti n uing committees and commissions and the NOTE OF like. Examples from the 43rd General Assemb1pwhich met from September to December, 1988, include Resolution 43/402, Adoption of the Agenda and Allocation of Agenda Items, and 43/301, Appointment of the Membe r s of the Credentials Committee designate years of celebration and various tributes and honors. Typical are Resolution 43/179, declaring a Transport and Communications Decade in Africa, and Resolution 43/90, noting the Fortieth Anniversary of the Universal Declaration of Human Rights consensus resolutions of genuine substance like, the resolutions of the 43rd General Assembly on the biennial budget plan but the unanimity recorded in the final votemasks the hard bargaining and tradeoffs that make it possible to achieve consensus at the end. Even then, consensus may have been reached only when some nation or nations retreated from a principled position. The meaningful divisions over issues of substance are hidden in committee proceedings or in informal negotia tions, if in fact they are recorded at all. Common to all of these categories of consensus is the fact that the final vote, or non-vote, is substantively meaningless. Including such resolutions in a voting scorecard, therefore, skews the record, making U.N . proceedings seem much more harmonious and collegial than they are. As in any legislative body, the most accurate record is that focusing on definable differences in interests, principle, and policy.The methodology used in the Kasten Report reflects that approach. Because of the proposed threats to the Kasten Reports integrity, The Heritage Foundations United Nations Assessment Project has tabulated and sorted the votes at the U.N. in a manner consistent with the Kasten Reports of the past five years.This report provides the necessary continuity and Comparability by presenting the percent coincidence of countries votes with the U.S. at the 43rd General Assembly using the methodology of the Kasten Reports. (This echoes almost verbatim the Soviet line against the U.S. position on development of defenses against nuclear weapons percent; average coincidence with the U.S.S.R. 97.97 percent Resolution 43/64 : Urgent Need for a Comprehensive Nuclear-Test-Ban Treaty Calls for an end to nuclear testing by all States in all environments for all time This, too, is the Soviet position and opposes the U.S. stance in an arms-control issue 5) Other Issues, on which th e re were 48 votes, include such resolutions as Resolution 43/49: Report of the Committee on Relations with the Host Country Condemns the U.S. for denying a visa to Palestine Liberation Organization chairman Yassir Arafat and establishes a special session o f the 43rd General Assembly held in Geneva from December 13 to December 15,1988. Resolution 43/137: The Situation of Human Rights in the Islamic Condemns Iran for various human rights abuses, although noting some hopeful signs. Since a majority of U.N memb er states have poor human rights records condemnations of specific countries indicate a nations diplomatic isolation more than anything else. Yet such enemies of the U.S. as Iran and Afghanistan have come in for much softer and less frequent criticism tha n do Israel and South Africa Republic of Iran Resolution 43/11: Judgement of the International Court of Justice of 27 June 1986 concerning military and paramilitary activities in and against Nicaragua: need for immediate compliance In effect, this resoluti o n affirms the International Court of Justices (ICT) opinion in Nicarupa vs. United States that General Assembly Resolutions constitute a form of international law, a position the United States has always and for good reason) strongly opposed. It also deni es the 5 U.S. its right, as expressed in the U.N. Charter, to deny ICJ jurisdiction over a dispute. Included in these votes were 27 taken on specific paragraphs of certain resolutions. There was also one procedural vote; the perennial illegal attempt to ex clude Israel from participation in the General Assembly by denying credentials to the Israeli U.N. delegation. The breakdown of voting coincidences with the U.S. and the Soviet Union on each of these topics is shown inTable IV Of these 166 votes taken in t he 43rd General Assembly, the U.S. voted for 15, against 112, abstained on 36, was absent once, and refused to participate on two. The Soviet Union voted in favor of 159, against two, abstained on two, was absent for one, and refused to participate on two . A list of these resolutions, their titles, and their respective categories appears in Appendix C Voting Blocs. In the General Assembly, typically, member states form blocs, much like the political parties in Western democracies.These blocs are based on c o mmon geographical, cultural, religious, political, and ethnic characteristics. Among the U.N. blocs are: the African Group, Arab Group ASEAN, Asian and Pacific Group, Eastern European Group, European Economic Community, Islamic Conference, Latin American G roup, NATO Non-Aligned Movement, Nordic Group, Warsaw Pact, Western European and Others Group. While there are other groups formally associated with the U.N like the Organization of African Unity, League of Arab States, and the Organization of American St a tes, the thirteen listed above comprise the best breakdown for analyzing bloc voting in the General Assembly. Membership in and overall voting coincidence by these thirteen major blocs is shown in Appendix A Non-Aligned Movement had a 99.36 percent averag e coincidence with the Soviet Union and only a 9.50 percent average coincidence with the U.S. On economic development and international regulatory issues, the voting of the Non-Aligned Movement as a group is even more skewed, with a 100 percent coincidence with the Soviet Union and a 0 percent coincidence with the U.S. Even excluding votes on issues regarding the Arab-Israeli conflict and Southern Africa (which together comprise 39 percent of all resolutions voted on in the 43rd General Assembly the average voting coincidence with the U.S. is still only 18.59 percent.The African Group, excluding votes pertaining to Southern Africa, has an average voting coincidence of 11.41 percent with the U.S. The Arab Group and the Islamic Conference have average voting c oincidences with the U.S. of 7.32 percent and 10.73 percent respectively By far the most powerful bloc with 99 member states, the so-called 2 Although the U.S. is a member of NATO and the Western European and Other Group and the USSR is a member of the Wa rsaw Pact and Eastern European Group, they are excluded from the figures in Appendix A for comparison purposes 6 when votes dealing with the Arab-Israeli conflict are excluded. These and other special categories are contained in Appendix B. Every year sinc e 1982, a group of countries has tried to prevent Israel from participating in the General Assembly. This attempt comes in the form of a vote on whether to accept the credentials of the Israeli delegation. Forty-one countries voted to deny Israeli credent ials in the 43rd General Assembly? Small Thanks for U.S. Aid. The U.S. failed in the 43rd General Assembly to get even those countries which receive substantial U.S. aid (except Israel to support U.S. positions in the U.N. Egypt the number two recipient of U.S dollars, receiving $2.3 billion in fiscal 1987 had an overall voting coincidence with the U.S. of only 8.62 percent. Pakistan received $646 million from the U.S. in fiscal 1987 and had a 8.94 percent overall coincidence. The average voting coincidence with the U.S. of the top 50 recipients of U.S. bilateral aid was 14.32 percent.Their coincidence with the Soviet Union was 96.62 percent. These countries and their individual voting coincidences are shown inTable 111 J CONCL U SION Making the reasonable assumption that U.S. votes in the General Assembly reflect U.S. policy goals and interests, the overall voting performance of the majority of the U.N. member states demonstrates that the U.N. agenda is largely inimical to U.S. i nterests. The U.S. is almost always isolated on the issues that matter most -those on which a vote is taken. Perhaps more important, the Soviet Unions positions are almost always endorsed by the majority at the U.N. With an all-time low overall voting coin cidence of 15.22 percent and more all-time lows among its allies, the U.S appears to be faring quite poorly at the U.N. Holding Nations Accountable. George Bush should take these appalling figures to heart and instruct his new Ambassador to the U.N. in Ne wYork to advise U.N. member states that their performance in the General Assembly will have a bearing on their bilateral relationship with the U.S.This should be backed up by providing the records of voting performance at the U.N. to each U.S. embassy abr o ad and requiring those missions to inform the local government of the record.The U.S. Ambassador then should advise the local government that continued poor performance will elicit appropriate 3 The number of countries voting to deny Israeli credentials h a s been as high as 43 in 1983 and as low as 39 in 1987 4 FY 1987 U.S. economic and Military Assistance Actual Obligations, in Agency for International Development Congressional Presentation, Fiscal Year 1989, Main Volume, pp. 504-507 7 responses from Washi ngton.
